NexaGuard CMP – Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) governs the use of NexaGuard CMP (“NexaGuard”, “we”, “us”, or “our”) and applies to all Customers, users, applications, websites, SDKs, APIs, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to comply with this AUP.


1. Purpose of the Services

NexaGuard CMP is designed to provide consent management and privacy signal enforcement technology.

The Services must not be used to:

  • Circumvent privacy laws

  • Misrepresent consent status

  • Enable unlawful data processing

  • Evade regulatory obligations


2. Prohibited Activities

You may not use the Services to:

2.1 Legal and Regulatory Violations

  • Violate any applicable law or regulation, including but not limited to:

    • Data protection and privacy laws (e.g., CPRA, GDPR)

    • Consumer protection laws

    • Advertising, marketing, or communications regulations

  • Process personal data without a lawful basis or required disclosures

  • Falsely claim compliance with any privacy or regulatory framework


2.2 Consent Manipulation or Misuse

  • Override, falsify, or suppress End User consent choices

  • Emit false or misleading consent signals

  • Modify or interfere with consent data for deceptive or unlawful purposes

  • Use NexaGuard CMP to bypass opt-out signals such as:

    • Do Not Sell or Share

    • Global Privacy Control (GPC)

    • Sensitive data restrictions


2.3 Data Misuse

  • Use NexaGuard CMP to collect, store, or process:

    • Sensitive personal data unlawfully

    • Data belonging to third parties without authorization

  • Attempt to re-identify End Users from anonymized or pseudonymous identifiers

  • Combine NexaGuard identifiers with external data to profile or track individuals unlawfully


2.4 Security and Platform Abuse

  • Attempt to gain unauthorized access to:

    • NexaGuard systems

    • Other Customer accounts

    • Underlying infrastructure

  • Interfere with, disrupt, or degrade system performance

  • Upload malware, malicious scripts, exploits, or harmful code

  • Perform automated scraping, probing, or load testing without prior written authorization


2.5 Network and API Abuse

  • Abuse APIs, SDKs, or endpoints through excessive or abnormal usage

  • Circumvent rate limits, authentication, or access controls

  • Use the Services to facilitate spam, phishing, or deceptive communications


2.6 Misrepresentation and Fraud

  • Misrepresent your identity, business, or legal authority

  • Use NexaGuard branding, logos, or claims in a misleading manner

  • Resell, sublicense, or white-label the Services without authorization


3. Customer Responsibilities

You are solely responsible for:

  • Your End Users’ data

  • Your privacy notices and disclosures

  • Obtaining valid consent where required

  • Handling privacy rights and DSAR requests

  • Ensuring lawful downstream use of consent signals

NexaGuard does not verify the accuracy of Customer disclosures or legal compliance claims.


4. Data Protection and Privacy

You must not use the Services in a way that:

  • Conflicts with your published privacy policy

  • Violates End User rights

  • Creates regulatory exposure for NexaGuard

NexaGuard acts solely as a technology provider and does not act as a data controller.


5. Monitoring and Enforcement

NexaGuard may:

  • Monitor usage for security, abuse, and integrity purposes

  • Investigate suspected violations of this AUP

  • Suspend or terminate access immediately if violations are detected

  • Disable specific features, APIs, or integrations as needed


6. Consequences of Violation

Violations of this AUP may result in:

  • Immediate suspension or termination of Services

  • Removal of data or configurations

  • Denial of refunds

  • Reporting of unlawful activity to relevant authorities

8. Changes to This Policy

NexaGuard may update this AUP from time to time. Material changes will be posted on our website.

Continued use of the Services after updates constitutes acceptance of the revised AUP.


9. Relationship to Other Agreements

This AUP forms part of NexaGuard’s Terms of Service and is incorporated by reference.

In the event of conflict, the Terms of Service shall prevail unless otherwise stated in a written agreement.
